By proceeding with this purchase you are acknowledging that you have read, understood and agreed to the Terms and Conditions of Use of Addicted to Pilates and the Addicted to Pilates Academy.
TERMS AND CONDITIONS OF USE
1.TERMS AND CONDITIONS
By accessing the Addicted to Pilates Online Teacher Training Program, you agree to be bound by these Terms and Conditions of Use, all applicable laws, and regulations, and acknowledge that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms and conditions, you are prohibited from using or accessing the Addicted to Pilates Online Teacher Training Program. The materials contained in the Addicted to Pilates Online Teacher Training Program are protected by applicable trademark and copyright law.
2.INTELLECTUAL PROPERTY
2.1. All Intellectual Property Rights in the course materials, online courses, and the lectures by trainers at the in-person courses are, and remain, the intellectual property of Addicted to Pilates, including any modifications or additions made during the course.
2.2. You are not authorised to:
A) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit, or distribute any of the course materials without prior written permission;
B) record the video or audio, relay by phone, videophone, social media or other means the online course or in-person course provided;
C) use the course materials in the provision of any other course or training whether given by us or any other third party;
D) remove any copyright or any other notice of Addicted to Pilates on the course materials;
E) modify, adapt, merge, translate, disassemble, decompile, any Teachable software used for the online courses.
Breach of clause 2.1 and/or 2.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any services, including but not limited to access to the online courses, and seek legal advice for recourse.
2.3. In consideration of the fees paid by you, we grant you a limited, non-transferable, non-exclusive license to use the course materials and the software in respect of the online course for the sole purpose of completing the online course and/or attending the in-person course.
3.USER LICENSE
3.1. You are permitted to access one copy of all downloadable materials on the Addicted to Pilates Online Teacher Training Program for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

A) modify or copy the materials;
B) use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
C) attempt to decompile or reverse engineer any software contained on the Addicted to Pilates Academy website;
D) share your login details or any part of the content with anyone else;
E) remove any copyright or other proprietary notations from the materials; or
F) transfer the materials to another person or “mirror” the materials on any other server.
3.3. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Addicted to Pilates at any time. Addicted to Pilates will regularly review logins and IP addresses to ensure compliance with these terms. If you are found breaching the terms, your access will be immediately removed and not reinstated.
4.DISCLAIMER
The materials on the Addicted to Pilates Online Teacher Training Program are provided ‘as is’. Addicted to Pilates makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights. Further, Addicted to Pilates does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
5.LIMITATIONS
In no event shall Addicted to Pilates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Addicted to Pilates Online Teacher Training Program, even if Addicted to Pilates or a member of the Addicted to Pilates team has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
6.REVISIONS AND ERRATA
The materials appearing on Addicted to Pilates’ Online Teacher Training Program may include technical, typographical, or photographic errors. Addicted to Pilates does not warrant that any of the materials on its website are accurate, complete, or current. Addicted to Pilates may make changes to the materials on its website at any time without notice. Addicted to Pilates does not, however, make any commitment to update the materials.
7.LINKS
Addicted to Pilates has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Addicted to Pilates of the site. Use of any such linked website is at the user’s own risk.
8.WEBSITE TERMS AND CONDITIONS OF USE MODIFICATIONS
Addicted to Pilates Academy may revise these Terms and Conditions of Use for its website at any time without notice. By using this website you agree to be bound by the then-current version of these Terms and Conditions of Use.
9.GOVERNING LAW
Any claim relating to Addicted to Pilates’ Teacher Training Program shall be governed by the laws of Australia’s jurisdiction without regard to its conflict of law provisions.
10.PAYMENT POLICY
Full payment (including all payments in a payment plan) must be made prior to the issuance of a training completed certificate.
11.WITHDRAWAL
Should you wish to withdraw from a training program after your manual has been downloaded and/or you have commenced the coursework, you must provide written notice to Addicted to Pilates. Please note the below refund policy.
12.REFUND POLICY
Addicted to Pilates does not offer ‘change of mind’ refunds. If you need to withdraw you must send a request in writing explaining the valid personal circumstances that prevent you from completing the course (medical emergency, prolonged illness, death in the family, or other extenuating circumstances). Note proof of circumstances must be provided. The personal circumstances that will not be considered as valid as they should be already known at time of booking the course are: weddings, work travel, holidays, personal relocation or similar situations.
If you have valid personal circumstance then you will also be required to advise which option you request out of the available options:
Option 1 – You may defer your course for up to 12 months.
Option 2 – You may request a partial refund based on your course completion progress:
- 0%-25% of the course tracked by the online progress bar – full refund of any payments made minus a $250 admin fee.
- 26% – 50% of the course tracked by the online progress bar – 50% refund of the total course cost.
- 51% – 75% of the course tracked by the online progress bar – 25% refund of the total course cost.
- 76% – 100% of the course tracked by the online progress bar or have downloaded a training manual – 0% refund of the total course cost.
In order to receive your refund, you must be clear in your written request of the valid reason for the refund request and also the refund option you are requesting. Refunds will be processed within 5 days of receiving your written request. If you are on a payment plan and your payments made to date total less than your course progress, you will be required to transfer the additional monies as per the above policy in order to withdraw from the course. Any bank fees incurred by transferring money are the sole responsibility of the enrolling student.
13.FAILED PAYMENTS
If a payment plan monthly payment fails, you will have 7 days to resolve this outstanding payment. If payments are not brought up to date within 7 days, you will be unenrolled from the course, and no refunds will be given. We will attempt to contact you during this time, and if you do not reply, this will be treated as withdrawal from the course. Certificates will not be issued until all payments are made.
14.COURSE TRANSFER
Should you wish to transfer to a different Addicted to Pilates course, a free transfer will be granted if you have completed less than 25% of the course. If you have completed more than 25% of the course, a transfer may be granted at Addicted to Pilates’ discretion with a $250 admin fee. If the course manuals have been downloaded you are not eligible for transfer.
15.COURSE COMPLETION AND ASSESSMENT
100% of the course content must be completed with full assessment submission, including correct logging of hours for certification to be awarded. This course is competency-based, which means if you are deemed competent you will receive your certification. If however you are deemed not competent you may repeat your final assessment until you are deemed competent, up to a period of 12 months from the course enrolment date. If you submit your assessment later than 12 months from your enrolment date, you will be required to pay a $250 late assessment fee.
16.REASSESSMENT
If your assessment is deemed not competent, we will provide feedback and suggest areas for revision to aid you in preparing for your re-assessment. Re-assessments must be completed within 12 months of your enrolment date to avoid a late assessment fee of $250.
17.PARTICIPANT HEALTH AND WELLBEING
As a participating student we advise you that it is your responsibility to seek medical advice prior to commencing any course if you are doubtful of your ability to engage and participate in exercise. Any form of exercise at Addicted to Pilates and Addicted to Pilates Academy is performed at your own risk.
You must inform Addicted to Pilates, Addicted to Pilates Academy and any instructors if there are any risks to your health by participating in the practice teaching sessions, including in a class or a practice teaching session. Risks to your health are considered to be items such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement (a “Medical Condition”). Where you have a Medical Condition, we strongly recommend that you seek approval from a medical practitioner to participate in any of our classes or practice teaching sessions. Participating in any form of exercise or course participation at Addicted to Pilates or Addicted to Pilates Academy with a Medical Condition is done entirely at your own risk.
18.APPEALS AND GRIEVANCE PROCESS
If you have any concerns, complaints with Addicted to Pilates or Addicted to Pilates Academy you will refer to the “Appeals and Grievance Process” located on the Addicted to Pilates Academy website that outlines in detail the steps that will be taken to resolve any concerns or complaints in a timely and satisfactory manner.
19.CODE OF PRACTICE
You will read and agree to the “Code of Practice” located on the Addicted to Pilates Academy website that outlines the expected behaviour, conduct and responsibility of all students, participants and instructors.
